1. Agreement

These Terms of Service (“Terms”) govern your access to and use of the Clearcote website and account services (the “Service”) operated by Clearcote Labs (“we”, “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility & accounts

You must be at least the age of majority in your jurisdiction to create an account. You are responsible for the activity under your account and for keeping your credentials and API keys confidential. Notify us promptly of any unauthorized use.

3. Acceptable use

Clearcote is provided for privacy, testing, and lawful automation. You agree not to use the Service to violate any law, infringe others’ rights, access systems without authorization, or circumvent security or access controls in violation of applicable law. You are solely responsible for how you use the software and the Service.

4. API keys & programmatic access

We may issue API keys that allow the Clearcote program to authenticate as your account. You are responsible for all activity performed with your API keys. We may rate-limit, suspend, or revoke keys to protect the Service.

5. Software license

The Clearcote browser is open source and distributed under its stated license (BSD-3-Clause). These Terms govern the account services on this website, not the software license, which is provided separately with the software.

6. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEARCOTE LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE.

8. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to comply with law.

9. Changes

We may update these Terms. Material changes will be reflected by a new version number and effective date. Continued use after changes take effect constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-laws rules.

11. Fees, subscriptions & plans

Paid Clearcote Pro subscriptions are billed in advance on a recurring basis and continue until cancelled. You can cancel anytime from your dashboard; refunds and the EU/EEA right of withdrawal are governed by our Refund & Cancellation Policy, which forms part of these Terms.

The current Pro plan is offered as “Unlimited” and does not cap the number of concurrent browser instances. “Unlimited” is subject to fair and lawful use: it is provided for your own use, may not be resold or shared, and may not be used to place abusive or disproportionate load that degrades the Service for others or to circumvent these Terms. We may apply reasonable technical safeguards against abuse.

We may change our plans, features, and included limits — including introducing a defined maximum number of concurrent instances in place of “Unlimited” — as well as pricing. Any such change applies prospectively: it may take effect immediately for new subscriptions, and for an existing subscription no earlier than its next renewal or after reasonable advance notice (for example, 30 days), whichever is later. We will not reduce the concurrency or features of a billing period you have already paid for. Where a change would materially reduce what you receive, we will give you advance notice and you may cancel before it takes effect; continuing to use the Service after a change takes effect constitutes acceptance of the updated plan.
